Personal bias, but I'm more concerned if Average Joe's target is a model airplane; the control link is the same. Drone or model aircraft, owner of the aircraft gets the onus of liability in any case, Average Joe faces charges if he gets caught, unlikely unless he is really stupid.

In the past there have been incidents of stupid people deliberately "shooting down" model airplanes by disrupting the radio link . These almost universally ended up being either people who lived adjacent to the field and were being jerks because of the noise , or disgruntled ex members of a club exacting a sick and twisted revenge . But now we're going to have specific computer programs sold with the sole purpose of causing an aircraft to fall uncontrollably from flight , and the FAA still thinks it's US who need regulating ? How about some laws making it illegal to knowingly & purposefully interfere with even the 1/2 pound sized drones , all the better to protect the public from falling machinery , right ? In fact , it should be flat out illegal to write such a program in the first place and selling such a dangerous program should absolutely warrant criminal charges to be filed under existing statutes of not interfering with "aircraft in flight" , especially now that the FAA thinks we're ALL "aircraft" .....

Since the FAA wants to classify our "toys" as civilian aircraft and wants to regulate as such it would be illegal.

It will take a lot more than a computer program. To paraphrase Sporty's remark, anyone who could do this is really anything but stupid. Malicious maybe, but that ought not to be confused with stupid. Realistically, Average Joe could not design and build the equipment required to do it even he had the computer program that controls it, nor could he afford to buy it.
