Default Notice for California AMA clubs

This is an informational post

5222. (a) Subject to subdivisions (b) and (f), any or all directors
may be removed without cause if:
(1) In a corporation with fewer than 50 members, the removal is
approved by a majority of all members (Section 5033).
(2) In a corporation with 50 or more members, the removal is
approved by the members (Section 5034).

The laws in your state may be similar

So guys, if your tired of being bullied and pushed around at your field by the good ol boys,
you do not have to wait for the next election to solve your issues,
just vote them out at the very next meeting!!!

WHY WAIT A WHOLE YEAR?

OK John, lets assume the club run by the good ol boys has more than 50 members and is a corportation. How many does it take to vote out the good ol boys, and how do you plan on getting that number out to vote?

Red,

Maybe a better question would be if the good old boys are elected by a majority vote of the membership at a scheduled election meeting then why would the same membership turn around and reverse their vote within the year? I would guess that no matter the organization you would have a hard time trying to get this type of action taken. From an RC standpoint, most guys just want to fly their airplanes and have as little to do with club politics as possible IMHO.

do just that ......remove their entire board in one swipe per Ca law.

If we don't like what they are doing,
we do not have to wait til next year like in national politics.

It goes in the clubs newsletter for a vote per CA Law. (thats how you get them there to vote Red)

You mean all this time there is a way of getting rid of a governing body in a club? or having the wherewithall to get rid of a group YOU personally are having a probelm with? My gosh, stop the presses, the public must be informed. John, this is ludicrous to keep bringing this up like this, you are doing yourself absolutely no justice and losing credibility besides.

Thanks for the information...... but I believe you leave off some very important things and did not address my statement. If a club membership votes in a board then why would they likely want to turn around and vote them right back out?

Secondly I don't believe it's so easy as you say to just "fire them now" without upseting the running of the entire club. Talk about problems...... utility bills, rent, lawn mowing, etc not getting done. As you stated "its (sp) just business". If that is the case then knee jerk reactions have no business in the "business".

I really don't see a reason to lock the thread if discussion stays civil. If John starts a thread that is strictly informational then both sides of the arguement should be allowed to be seen. If both sides can not be seen then by all means just pull the thread instead of having a one sided discussion with out regards to facts.

Nooone has personally attacked you, instead we have taken you to task about your attempt to present an argument in the purest of intentions when in fact your vail is transparant.
if it is a personal attack to call your bluff and call it horse poop instead of chocolate than fine I am attacking you, and your credibility and your intentions.
However,I do not believe I am attacking you ata ll personally. What I find more ridiculouse is that as soon as someone disagrees with you or calls your bull...bull than you want the thread locked. Jimmy Skids, Ithink in your own state a governor was recalled months after an election in which it was found he had less than truthful to the voters. It does happen and there are times when this is possible.

SSRCCPREZ. I think you are not capable of deep reflection, only knee jerk reactions. Since you haven't been thru a situation such as John C. of maybe i have, you know nothing about people using by-laws to twist the club into their control. I for one did not know there were state laws regulating these things. I once dealt with a situation where the club president tried to use the by-laws to stop almost the entire club from taking action against something he did in the previous months meeting. It would have been advantagious to us to have known about the possibility of state laws on this, seeing i had no idea that state laws addressed these kind of issues.

True, Gray Davis was recalled and replaced by the Governator. However, it wasn't as easy as John makes it seem with a club. Over 90 thousand signatures to just start the process. Not to mention that removing the governer of a state (a big deal any where) is no where related to removing the whole board of a model airplane club. Maybe the state legislature would be a better comparison but alas, this too is way off subject. The discussion here revolves around how to remove a board, and I have added to the discussion on the subject of the fallout of said actions.

I am doing my best to keep this civil and leave the past discussions relating to John's personal situation out of this.......... (hopefully that didn't just cross that line).

As for the locking down of this thread I again state that there is some relevant discussion going on here and would ask that as long as it remains civil, leave it be. If John doesn't like the feed back received then I would suggest that he limit the amount of discussion threads he starts and the subject matter, or just doesn't read them.
