Who to believe, AMA or FAA
AMA:
"I will not fly my model aircraft higher than approximately 400 feet above ground level, when within three (3) miles of an airport without notifying the airport operator."
FAA:
"Do not fly model aircraft higher than 400 feet above the surface. (period)
When flying aircraft within 3 miles of an airport, notify the airport operator, or when an air traffic facility is located at the airport, notify the control tower, or flight service station."
The FAA says never above 400 feet but the AMA says keep under 400 only near airports.

The FAA won't do anything if your not in a position to actually endanger aircraft. I live near 2 airports (1 civilian, 1 air force base) and have never heard of it being a problem. I know you can't fly above a certain altitude on the base because the military doesn't want your rc plane getting sucked into a F-16's turbine.
Obviously the FAA would override the AMA. The AMA can't stick you in prison with a federal offense and a $250,000+ fine.

I agree the FAA doesn't really care too much. The cops don't come after me for setting off firecrackers in the middle of the woods either.
My point is that "the law says.." and the AMA says different.
I am betting there are a lot of AMA members who will argue that AMA is right and the FAA is wrong.
I'm just trying to prove that the AMA is not the perfect thing so many make it out to be.
I want to fix some things. Seems that is considered "hate speech" by far too many members.

This topic always comes up when someone is looking to stir things up. The real answer is - There is no "law". There is an advisory circular from the FAA. That circular is not enforceable. The AMA has the safety code. That's not law. There used to be a very cooperative relationship.
But since 9/11, the FAA is paranoid, and with the improvements in unmanned aviation, many people have tried operating commercial ventures under the "hobby" designation and ignored existing FAA regulations for commercial aviation. The result was the recommendations from the panel, and the FAA will be issuing new regulations. When? Who knows.
Once that regulation is put in place, we can discuss what the law says. Until then, they're both right.

This issue has been discussed many time and in great length here on RCU. As there have been no changes to the base issues involved here Idon't see any reason to keep this discussion going on here. I'm going to go ahead and close down this thread.
