Well folks I just got a letter from the AMA's lawyers telling me to stop defaming them here on RCU ot they will take legal action against me.
Our dues at work.

Defame = To damage the reputation, character, or good name of someone by slander or libel
Interesting because to damage someones rep you would have to use words falsely spoken (not facts) or you would have to be doing something malicious with the intent to defame

How do we determine or discern one's intent? What statements would indicate an intent to damage or defame another? Can defamation be done in an electronic chat/discussion forum? It is all in how one perceives the typed words on these forums. Without talking to the individual you simply cannot know their disposition or intent about such things.

For me, I think these conversations (electronic chats) are very open and if nothing else thought provoking. Not sure that anything here could be viewed as defamation. Most statements can be backed up with factual information.

Anyway this is certainly another interesting post! [X(]

Just wondering. Were they referencing any particular thread? Or do you do this on a regular basis? Or is this like asking when you stopped beating your wife?

I am not allowed to use "phrases" like defrauding the IRS, cheating on mailing costs, and providing false information.
Although every opinion I put forth is backed up by AMA documents and IRS citations, it seems I can't express my beliefs anywhere anymore without being threatened.
I never relealized that my comments here at RCU over the month of August 2010 is the reason the AMA membership has been in decline for the last decade.

If you're going to make such public allegations with only your interpretations, don't be surprised when the lawyers get involved.

If they are afraid of my opinions backed by facts and need to threaten me for experssing my opinions, I wonder what kind of an organization I am a member of.
Maybe they would do better to address my complaints instead of telling me to shut up or get sued.
The AMA itself is the reason membership is declining. Maybe if they would listen to disgruntled members instead of threatening them, they might find their real problems.

I am complying. I am not using the "phrases" that they find offensive. I have not defamed them in anyway in this thread (or IMHO at any other time). Any defamation they percieve is a failure to acknowledge that my opinions and beliefs are based on their own documentation.

Defences to claims of defamation include:

Statements made in a good faith and reasonable belief that they were true are generally treated the same as true statements
Opinion is a defense recognized in nearly every jurisdiction.
Fair comment on a matter of public interest, arguments made with an honest belief in their soundness on a matter of public interest .
Claimant is incapable of further defamation–e.g., the claimant's position in the community is so poor that defamation could not do further damage to the plaintiff.

I'd like to know if a Muncie person took the time to show you the numbers
and educate away any ~misinterpretation~ you are under, in regards to those subjects
... or if its just an attempt to silence problem spotters thru lawyers.

To wit:
Has anyone at Muncie explained the actual position of MA Graytext$18 millions to you,
or are you/we still in the dark about if it is really magazine 'profit' generating revenue or not.
In that, if we tell the Members its profit then we should tell the IRS it profit. Right?
Cause getting the answer would go a long way to eliminating supposedly slander/libel talk about why we dont get the answer

No? You just got a 'Shut Yer Trap Or Else' letter instead?



Cause it seems most of your ~statements~ could be cleared up by AMA information/disclosure
rather than silenced by AMA lawyers

and rake into AMA millions of dollars from Cisco!

Our (ama's) financial concerns are over, and we wont need to raise dues for a long time.

No, AMA insurance does not cover the hoi polloi for libel. The EC (and other officers - there was talk of extending it or similar coverage to chartered club officers) are covered for that risk by a separate D&O policy, at our expense of course.

Your HO does cover such risk. So do PUPs; you might have better spent the $58 to increase the limits of coverage from real insurance companies you do business with.
