When you connect the battery, do you let it sit still for a few seconds? Also, the rudder servo will usually glitch or shift the arm when the battery is connected. Does it do this? Is it the stock 704 rate gyro?

As Eveedub said, it takes quite a bit of time for the gyro to arm. The heli should be sitting still on a level surface, the rudder trim centered and the throttle trim all the way down. If the gyro does not arm, then I would begin to think your gyro has issues. (Unless your transmitter has issues.. such as you have the throttle channel reversed or the trim pot on the throttle is not really electrically going all the way to low throttle.) When you say it works with the gyro out of the loop, Do you actually have full control of the heli? (When you throttle up the throttle acts as it should, etc.)

well i have the gyro working now, the rudder trim needed to be a bit to the left to make it work but now i have another problem, it seems like the gyro is very sensetive even with the gain turned down but gets worse the more gain you have, i can get the heli nearly into a hover but the slightest touch of the rudder and it spins and then you try to correct it and it spins madly the other way, its the standard gyro by the way and use in getting a better one or should it work great

For some reason, that sounds like you has the gyro settings reversed. With the gyro mounted behind the servos & label facing up, gain on mine was set to 75-80%, switch in "REV". Transmitter servo switch for rudder in "REV".
