It is my understanding that the FAA regs against current UAV and FPV (out of visual range) activity deals with commercial enterprises. If you stay under 400' AGL and are a hobbiest I believe there is nothing "illegal" about it as far as the FAA is concerned.

Mark,

I actually spent some time on the phone with the FAA official in charge of UAS regs. I also spoke the the AMA official on the same topic. I had this conversation with them about a month ago. Here is a link to the two offical pertinent documents on this topic.

http://www.rcuniverse.com/forum/m_6905119/tm.htm

Here is my synopsis from those discussions. The FAA denies activity in the National Air Space (NAS) unless explicitly granted by regulation. The 1981 AC91-57 provides for model airplane hobby activity. They assert that there is an assumption that the pilot has direct visual contact with the plane. There are only provisions explicit for unmanned aerial systems (UAS) in the FAA definitions for "Public" and "Civil" use, nothing for "hobby". Both require some level of airworthiness certification. FPV flight is not well defined by current regulation either as a hobby or as a commercial venture. Processes have started to modify the regulations to provide that better definition. In the meantime the FAA will probably not act unless there is an accident.

The AMA takes a more aggressive stance. They state flatly that if you are not controlling your airplane with direct visual contact then you are violating AMA safety rules and this will void AMA insurance coverage you have through membership in their organization.

I am not an attorney and do not claim to be an expert but I do know that the legal world makes their money interpreting laws and regulations and then providing opinions. All legal opinions are only confirmed after being tested by the court system. Presently much of what new technology has added to the RC world is not well defined by regulations. While the government may be slow to act they usually win. Our tax dollars guarantee that. Having said that I think everyone should proceed with their interests with their own level of comfort and understanding of what is allowed.

Good Luck!

Bill

Someone will always push the limits until somebody complains or gets hurt. Then we all get regulated. It's human nature. I've always held the opinion that you can't legislate common sense.

Well writen synopsis Bill.
