If I were a betting man I'd put my money on it in this way: The FAA has authority over US NAS, all aircraft including RC models. As long as we RC modelers follow the "voluntary" guidelines...

Class B airspace normally goes to ground level (no way to go below ground level and fly :-) ) and looks like an inverted wedding cake. The Statue of Liberty isn't in the exclusion area.

I think the airspace around and above the Statue of Liberty the vehicle flew through was FAA controlled airspace.

I've flow 18 years. Been through sticks, pattern, profiles, various sport planes. Not looking for a stick, looking for a full aerobatic bird. Just advice to transition to gas.
