yes is not against the law in some states but its against PayPal Terms of service and to make the story short you can't ask for the 3% or 4% because is against there Terms
the Seller can ask for whatever they want. They can easily say the 3% is a handling fee. If you dont want to purchase an item from someone bc of the 3% they may ask for, then move on. Who are you to tell someone what they can and can not do?
