Default Futaba FP-5NLP legal ?

Greetings all,

Is a FP-5NLP legal ? It is FM & PCM , 72mhz. It does not have a "gold" sticker on the back , But according to this it is legal :

Yes, being a PCM transmitter, it is legal for use.
