(LMOA) Shen, If I hadn't been totally flabbergasted, I probably would have. I absolutely could not believe he was serious, even after he handed me the ticket! I just kept asking if he was joking, and straight-faced , he kept saying, "sir, I'm not joking". And even after I "payed my debt to society", I can't believe it actually happened. Since I was fined for operating a 1/16 scale military vehicle, does this make me a war criminal??????

There is no way a 1/16 RC tank counts as a motor vehicle. The guy was just being a Sh disturber. Yeah I would go to your newspaper, but go to the Parks board as well. Just start being a Sh disturber yourself.

If a toy gun, non gun, airsoft etc resembles a real firearm in size and color it is classed as a replica and therefore prohibited here in Canada.
Last time I was in Canadian Tire, over in Sporting Goods they had a number of very realistic looking Crossman Airsoft pistols for sale. Salesclerk even let me handle a couple of them. How can C.T. sell these if they're "prohibited" ....??? (Picked up a big jar of Crossman BB's No Hassle. Apparently, no F.A.C. requirement for the BB's OR the Pistols.... )

There was a little grey area concerning airsoft guns.
I know one airsoft store in Vancouver that was swarmed swat style and shut down.

JZ - Good thing you weren't sipping a beer! If he considered that operating a motor vehicle does that mean he could have arrested you for DUI?!

By the way, you should have fought the ticket, brought the tank to court, and made him look like an idiot [and I'm a police officer] Does this citation give you points on your drivers license??
Google search results: http://public.findlaw.com/traffic-ti...affic-law.html

these are your states legal definations:
§ 125. Motor vehicles. Every vehicle operated or driven upon a public
highway which is propelled by any power other than muscular power,
except (a) electrically-driven mobility assistance devices operated or
driven by a person with a disability, (b) vehicles which run only upon
rails or tracks, (c) snowmobiles as defined in article forty-seven of
this chapter, and (d) all terrain vehicles as defined in article
forty-eight-B of this chapter. For the purposes of title four, the term
motor vehicle shall exclude fire and police vehicles other than
ambulances. For the purposes of titles four and five the term motor
vehicles shall exclude farm type tractors and all terrain type vehicles
used exclusively for agricultural purposes, or for snow plowing, other
than for hire, farm equipment, including self-propelled machines used
exclusively in growing, harvesting or handling farm produce, and
self-propelled caterpillar or crawler-type equipment while being
operated on the contract site.

§ 159. Vehicle. Every device in, upon, or by which any person or
property is or may be transported or drawn upon a highway, except
devices moved by human power or used exclusively upon stationary rails
or tracks.

Well this is sort of off topic, but again with silly rules and laws. About a week ago, I decided to take my tiger and pershing to a county park not too far from home so my son and I could run them for a while. A park ranger was watching us for about ten minutes and drove over and commented how they were pretty cool and then told me I was being ticketed for "operating a motor vehicle on county parklands". I laughed at first then realized he wasn't kidding. $100 in fines with a bench appearance in court. Only in New York. Regards, JZ
What a jerk, i will be really interested to hear how this one comes out!? What the heck are parks for if you can't play with Toys there???

LOL nail them with that one, it says "tracks", you thought you were covered since it runs on "tracks" as the law states :D

The real worry is how these stupid laws come into being, any fool can propose a new law no matter how stupid or ill defined it is, but it takes a majority in parliament to then pass them into legislation, and since these types of laws do make it through then the evidence suggests that the majority of our parliament is composed of fools. what hope have we?:D

Thing is, politicians are a cut above the rest, I mean, they're removed from regular life: they get their big salary and massive payout when they retire - whatever rules they impose or dream up don't actually affect them (they make sure of that), and only when they do do they actually change.

Wonder what customs would do with an assault gun?

Provided it didn't have the word gun written on the packaging they would probably let it through, it seems clear to me that its not the items themselves that are dangerous, only the words written on the package.

I wonder what would happen if I posted you a box of papers with "Gun", "Bullet" and "Dangerous Weapon" written on each page - would they confiscate that too? ;). Sounds like the Thought Police run the land of Oz! lol

RE: BB's Confiscated

correct me if I'm wrong but does the law state that if you say "hands up" This is a stick up give me your money" or some words like this even if no money or valuables were taken, isn't this called attempted robbery. I'm pretty sure that is what the law defines as this so even if you use a bright colored plastic gun or even our little tanks and say some words like this it would be constituted as an attempted armed robbery. I am pretty sure there have been people convicted by doing this not the tanks but plastic guns or even a candy bar stuck thru the pocket of a coat or shirt. So guys don't do this HE HE HE HA HA HA LOL LOL.[&:]:):D;) I'm with you guys it is stupid laws and as the people I know around me are saying vote them out until we get done what we want done, make the goverment work if you keep voting them out sooner or later this dumb A!@#$~@%@$% will get the message. Well maybe not. They will just pass the laws faster after all they are the goverment. Well good luck at least here we can still own guns at least for now any way well know after November 4.

Blitz, I guess the parks here are just for picnics and softball . August 12 is my court date. I am bringing my tank with me. I hope I do make the park ranger look like the fool he is. Maybe its a boring job and he just had to do something, and I was his only excitement for the day, or perhaps he was terrified by the thought of panzershreck-weilding chipmunks. Who knows. This will come to pass, and I'm pretty sure at least someone will get a good laugh out of it. Best regards, JZ

They will probably stop you from bringing it into court since it fires BB's and BB guns and other forms of weapons aren't allowed to be brought into courtrooms

Glue the hatch shut (mildly) and ask them to prove the BB gun works.

I would also take your son and ask him to look upset (he probably was at the time of the incident), use the same tactics that real criminals do. What have you got to lose?

I hate mindless bureaucracy.

RE: BB's Confiscated

This "security" fiasco is a totally out of control section of the laws in about any country. I had an Airsoft AK-47 to use with a museum maniquin, and after we reworked it, the AK was not needed. I could not sell it on Evilbaye due to it's identity...not that it had anything to do with a real one, and even the BB mechanism had been destoyed and the orange tip replaced on the muzzle. Same with a CANVAS magazine pouch for AK mags...ad pulled due to its nomenclature linking it to AK. It's really a wonder that RC tanks are allowed at all....as with laptops on aircraft, they can very easilly be used at triggers to luggage areas and RC tanks, cars or aircraft can be used to covertly run small but lethal bombs to a target. I have had severe headaches just flying to Germany with my musical instruments. My oboe, oboe d'amore and English horn all have 23 adjusting screws which can be easilly mal adjusted by air pressure and movement during travel. When I get on a stage with an orchestra or chamber ensemble, the small jewelers screwdriver and spring hook (3 in long with a 3-4mm tip), MUST be there to make minute adjustments for proper response and tuning. Until recently, these have been confiscated at the airport as "dangerous weapons", but nothing has ever been mentioned about the 6-8 inch long sharpened pencil in the instrument case, which I stressed, I could use to take out someone much easier. One German border police girl, argued once in my behalf and said she played clarinets, stressing that the small adjusting screwriver was essential to playing the instrument. She was ignored and I had to buy new ones in Germany. Importing RC tanks is real tricky and so many minor issues are blown out of proportion and bigger issues which should be looked at are ignored....confiscating locally available plastic BBs and letting the operational tank and gun through[X(]...hey it's all government run[:'(] I can only immagine the hassles that HL and Tamiya go through in some countries. I'll stick with buying and rebuilding them...let someone else deal with the feds.[&:]

JZ, good luck on the court......hope the judge reprimands him for such a stupid act. Bringing a crying child along may help:eek:.
Good idea to bring the tank have it inspected at the chmber door and make sure it's the one with the lowest velicity gun and softest BBs. [>:]
On the aspect of airsoft or toy guns,,,,Ern can back me up on this...they are being made to look so real, that it is a VERY delicate and dangerous situation for any police officer to check out. With children 10-13 being recruited into gangs and carrying live guns, for a police officer to check out a child carring/playing with a realistic looking weapon, the situation can turn from an innocent look-see with a child playing to tragic confrontation in a nanosecond. It is infortunate that some valuable police officers have been lost due to a "bad" decision (there IS NO right decision) which resulted in tragic results for the child or officer....either through death or legal procedures.
Painting or molding guns in bright colors is stupid, because I can paint my 45 auto brigjht red, pass by a dozen people and blow away someone at my choosing. I have a blank firing 45 auto that fires 8mm blanks only...has no bore and made of pot metal...but wearing vintage Army uniforms, will pass for a live 45 any day.

I believe it incumbant on all of us to start contacting our congressmen/women and educating them on some of the issues, even meeting with them and showing them hands-on. We must ask(demand) some changes or clarifications to some of the laws governing the RC hobby and protect our vastly growing RC hobby. The way the security fever is heading , I forsee severe restrictions combined with the lack of education about the RC tank hobby that will drastically impede our ability to use them. I ran my 1;1 scale tank with a subcaliber 12 ga shotgun mounted in the canon for over 5 yrs and didn't have as many problems as some of our RC guys are having with plastic BB firing tanks. ;) OK, as a former 1SG, I can argue Army style and bulldoze my way through, but there are laws we have to reapect. :D Lets get our congresspeople educated and on our side. Election year...

RE: BB's Confiscated

"trust" is the questionable word. Worse here in South carolina....plenty of laws on the books but they are not enforced, so they just waste out tax time and dollars to make up new laws, which are equaly un-enforced. Election years should be designated "retribution years" so we can attempt to get someone in there to do the job. This upcomming presidential election is damned scarry. [:@] We may soon have to keep, our RC tanks in the cellar and don't let them be seen around any new mosques that will be built.

Australia has the best prime minister and I highly respect the speech he made regarding certain peoples who don't want to adhere to Australian laws and lifestyle. ;)We need legislators in office to take charge of laws governing our hobbies to weed out Mickey Mouse and "cover it in case we missed something" laws. So many of our RC guys have been having problems because of a total lack of education of laws or those governing RC and "toy" guns. If we don't elect good people, our miliitary oriented hobbies will suffer under the guise of "national security", where common sense is a totally unknown factor.[:@] We need to get the ball rolling and get everyone involved in RC hobbies to contact their congressman about some of these laws based on ignorance.

I'm with you on the airsoft guns. They look so damn real, they need to be handled like they are real. Unfortunately gun crimes in schools and colleges have left little room for guess work in this regard. I own an airsoft gun, and I treat it like a real gun. I don't brandish it in public places,. As it has been pointed out, how can we expect officers to be able to take the time to determine if a gun is real or not. If it looks like a real gun it must be treated like it is a real gun. IMO people who own airsoft guns should use common sense when handling them.

However airsoft toy tanks do not look like dangerous weapons, so back off on those. Examples of these being confiscated or held up in customs are examples of how idiots can spoil common sense laws. Much like the park ranger in handing out a citation for operating a powered vehicle in a park. The law in place is a good one, how it was enforced is ludicrious.
