A lack of proper maintenance records is not proof of a lack of maintenance. A threat of small claims court will usually shut them up.
Techinically you are correct, but only because it's cheaper to avoid court and fix the stupid piece of crap than it is to go to court and win. You're really new to the whole car thing aren't you?
