Contrary to popular opinion in this forum UAVs, hobby or not, are aircraft. Certain types of hobby aircraft are exempted from the FAA regulations by law but only if they follow other regulations. Just because you call it a hobby RC plane does not mean that you have full control over what you can do with it. Specifically, you cannot use the exemption for any commerical purpose. And taking pictures to sell rag magazines is a commercial purpose. But hey, these people have never cared about confidentiallity, privacy, or even basic dignity so why should they care about legality.
