Section 336 has no 400 foot requirement outside of 5 miles from and airport. The FAA interpretation does not mention any other requirement. So unless the FAA changes their mind from their interpretation the matter is moot.
Did I miss something? Has AC 91-57 been resinded? If anything it has been expanded and amplified. The "notify" airport has always been there as advisory for over 30 years and now the 112th Congress has mandated and expanded it to Five miles to maintain exempt status. Hardly a "moot" point. The AMA asked for and got an exception for model aircraft. The FAA is now obligated to define what is being exempted and still maintain the safety of the NAS. Be careful what you wish for.
