They never have in the past, that's for certain. However, if the pilot also gets to close to a full scale aircraft or too close to an airport, then the FAA is far more likely to take action.



An unintentional misspelling by the OP.
The 400 foot rule is broken at every NAT and the FAA has never complained. In fact some FAA officials are members and have been to the NAT's. I believe they have also said they have no problem with the AMA's rules.
