This is actually a gray area. The FAA has said that if you post videos on YouTube and have one of those accounts that gets the pennies per view or whatever, (get paid for the videos) then you are no longer a hobbyist and it is commercial use and fall under the FAA UAS rules. I don't know of anyone getting busted for this but think they have used this for the guys posting the dangerous stuff on YouTube that get a ton of views.

In the same line of thinking last I heard that manufacturers of our hobby are in commercial endeavors and are technically not allowed to test or fly their stuff under the hobbyist rules. I have not heard of any of them getting in trouble though.
