They are classified as Intentional Transmitting Devices under both FCC and EU (now under RED)
Even a receive only system would need to be certified for Unintentional Radiation
Passive from the standpoint that other higher priority transmissions have the ability to over power our class or bandwidth.
Our systems cannot be strong enough to cause interference with official use communication systems.
