Dear David,
A turbine ordered by Paul was sent from JetCAT USA straight to his address in the US. The turbine was paid by Paul's Visa card to us. I am working now for a company and am sales manager for Asia and travel a lot. During my absence, my business partner Yves, was unsure whether or not the turbine actually was shipped or he had to pay for the invoice already. Bob did not get a reply from me, and Paul stated to Visa in the meantime he never received the turbine. We were debted by Visa as we could not proove we had sent anything to him (the turbine was sent by another company -JetCat USA- to the customer, without any export document or shipping document from us).
So Paul had the turbine ànd his money back, and nor SpiderJets nor JetCAT USA were paid. I thought I had solved the matter with Bob as Bob asked to Paul to pay in cash in his office, so everything was finally settled. Paul wanted me to issue a letter stating that I would not charge his card again for this turbine (I do not see why...), which I faxed to Bob Wilcox immediately. This was two weeks ago and I am unsure if Paul has kept his promise to pay to Bob Wilcox in the meantime. Judging by the last e-mails, this has not happened yet. I am convinced that Paul is a sincere and honest man, and I hope the matter is finalized as soon as possible by his final payment to Bob Wilcox. Paul has clearly confirmed to Bob Wilcox he had received his money back from Visa.
It puts all of us in a very strange situation : nobody is paid, the customer has the goods ànd the money, he has declared officially never to have received anything, so juridically speaking we (SJ) do not even have to pay for this invoice as the goods were officially never shipped. (!)
Nevertheless we all count on good common sense, so the matter is solved soonest. In the meantime my other US customers are waiting and cannot be supplied, as I am no longer seen as a US dealer as long as the matter is not cleared (by Paul's payment). Bob and JetCAT Germany have promised to me however that SJ would be still be a JetCAT USA dealer as soon as it is solved with Paul.
Sorry Paul, but at this point I cannot help you or your friends, like you said in your previous posting, and my other US customers, as long as you do not pay for the received P120 turbine to Bob Wilcox.
I was also debted last year by American Express for a turbine you have received and for which you made a complaint against my company. I do not know if you were refunded your money also that time, but I was debted for the full amount and the matter with Amex is still unsolved up to date, I guess now one and a half years later. I still wait to have my money back from Amex as I could proove with all documents that I had sent everything you paid for from Belgium. What I could not do this time, as explained on the above. The matter with Amex is now somewhere in an administrational no man's land, apparantly, and as for me, I only should be patient.
Once again, I am confident that Paul is honest and someone you can count on, this is my personal experience with him, so I believe the matter will be solved soonest.
I do not ignore to take my responsability for my absence abroad this summer, for sure the base of many misunderstandings and inconveniences. And definately, we're not out of business like was written several times on RCU....
