I use Spektrum modules and a Futaba 3PK. The Spektrum module has a built-in failsafe, but like you said, it malfunctions when it is supposed to hit the brakes. Another thing I noticed is the failsafe would fail to work at all because the receiver batt is so run down.

Now, when my car or truck starts to respond funny when I throttle, brake or turn, I stop it and take it in to charge the receiver batt. I take it as a sign that the receiver batt is so low that the failsafe is attemting to make its final input before all power loss.
