Since we haven't heard from Highstrut I can only guess
that we haven't really heard all the facts. Even from one side.

Example 1. At a club meeting AFTER Jan 1st(new calendar year)
this person gets really rude at a meeting and it comes to blows.
No question there...........he's out ! Nothing refunded.

Exapmle 2. IF an incident happened in Oct , Nov or Dec and the
club didn't straighten this out until after the next
years dues were already paid, and then decide to
kick him out , do you still think this is fair and the rule
of no refunds still applies ? I think not.

In this case if there was a good chance he was going to get thrown out ,then
the club has the oblagation to iron this out BEFORE accepting his dues.

That's why I'd like to know WHEN this person screwed up so bad
to warrent being thrown out before the flying season even started.
We are only talking about 2 MONTHS here.

Unless we get more facts, this thread is almost useless.

I see where you are going with this, but it all goes back to By-LAws. If the By-Laws state no refund than it means no refund regardless. If it states partial or prorated than so be it. There arent usually exceptions to by-laws, and if there were to be, it would be up to the memership to "set aside" the by-laws per robert's rules to make an exception. the "setting aside" of the rules takes a 3/4 majority vote first, then an motion to make an exception would have to be made and seconded.
truth be told it ALL depends on the By-Laws and the presiding member.
