The vicarious liability involved in a local club rule isn't so much the likely random inforcement. Its the fact that the club has made record that it is aware of a safety issue and has decided to continue to operate. From that moment on, the club is now exposed whenever there is any incidentinvolving that issue. (Which is very likely going to be always.)
