I have just about finished the build and found that the ailerons near the root are not equal distance from the bottom of the fuselage. One aileron is about 3/4 inch from the bottom and the other is about 1/2 inch. Has anyone else come across this problem and if so how so I correct it.

Please clairify - do you mean that the gap between the ailerons and the fuse is different on each side, or that one aileron is higher than the other relative to the bottom of the fusealage?
If it's just an issue with centering the throw to match on both sides, that's a little bit difficult with this particular plane since there is nothing on either end of the aileron to reference it to. I put a stright edge on the wingtip between the center of the leading and trailing edges and then match the end of the aileron to that. Repeat on both sides and the throw center should match.
