New Axe CP..Lemon or is this it ?

I picked up a Axe CP 1 1/2 weeks ago. I've formerly flown a Blade CP and was getting into forward flight, but sold it to help pay for a move. I've always prefered the rigid chassis of the Axe over that of the Blade...so this time I picked up the Axe. I Charged up the batteries, installed the blades, ran her up and checked for level and all was good.
Within my first flight, the Gyro felt way off to me and I had to add a lot of right rudder - (not sure if thats the right term for heli's). I adjusted the trim for the rudder and that was good, but getting her to sit still was another challenge in flight. The tail can be a real pain to hold onto. I've adjusted the gain on the Gyro and that helped.
Now here is my current and continuing issue... During Flight, all will be good for a short period of time. I can bring her up to eye level and hold it rock solid in air. After, what seems to be a minute or less, it progressively becomes uncontrollable, ending with a landing and restart. After the first run, its controls just don't seem to come back.
I feel that its a battery/power issue, but sometimes its been hard to handle at first, then gets better.
When in air, a full push on the throttle and she will climb, but the tail can not keep up, no matter what my gains are.
The problems feel like POS electronics. Slow response, Gyro does what it wants, Battery power fluctuates, tail can not keep up with heavy rotation....so on. I can justify upgrading anything on it, when i could get an Align SA Chassis for just a bit more.
I never seemed to have any of these problem with my Blade and i'm curious, is this just the way these fly? I'm probably going to take her back if I don't find a solution by Monday. I'd rather just pay a bit more.

She flies. I screwed around with it a bit more last night and found out the pots for Gain and Tail adjustment where stuck. They each only had about 40degrees of travel. I turned each harder and they both freed up...giving me the full range of adjustment. I've learned in the past not to wrench a stubborn pot, but i did it anyways and they both now give me a full range of adjustment. I was finally able to adjust the feel in the tail and I can lock it pretty well now. I plan to spend a bit of time today tweaking the settings, buts she's 200 percent better feeling and I'm finally satisfied with this chopper. I was really sad with the idea of taking it back. The frame on this is sooo much nicer than that of the Blade.
Didn't get any responses, but thanks for at least taking a lot.
