Default HPI E-10 Battery

Can you use nimh 5000 battery on a stock e-10 or is it bad for the battery or car.

Yes you can. Assuming its a 6 cell 7.2v pack you can use any mah rated pack you like. The mah determines the runtime so a 5000mah will give you a decent run time.
