Mack101,
Stand in front of a mirror and repeat this… Well I took the transmitter that I knew was damaged in shipping and the helicopter that swings its blades AT OVER 1000 rpm and my daughter and went outside. Put the battery in and hooked it up and surprise there was an accident.
Sounds stupid doesn’t it. The company doesn’t owe you any replacement parts for the helicopter, at most they are responsible for repairing or replacing the transmitter with the broken switch. Hopefully your wife will keep your daughter well out of harms way the next time you decide to engage in behavior this foolish and reckless

I'm sorry but I must say that suing the Vendor for that is
not too different from buying a car, learning that it has a broken brake in your garage,
then you drive anyways and get into a collision(accidents are when you just get unlucky) and blaming your dealer.

I would be just glad that 10 years old daughter isn't hurt.

I respect that you are hurt, and ver upset that this all happened
because either the vendor sent you the transmitter broken, or it got broken from shipping.

but you did mention that it was you, who plugged it into the computer and learn that the throttle doesn't work.
and you saw right out of the box that '3D switch' was broken off.
(I would understand if you are a beginner, because I almost created a mess with my first helicopter, just for wondering what "Idle up" meant)

If you still think that was someone else's fault even after, you think over all these.
and you wish to bring up the law-suit to the vendor

I have only one more thing to say...
I'm sorry

i have tried to bite my tongue and not weigh in, but i cant anymore [sm=75_75.gif] ...why does anyone who believes that "i have a lawyer" believe that they can never be wrong and or take personal responsibility? ...somehow the entity with the (potential) deep pockets is always wrong ...why? ...because "my lawyer" says so. No slight against the profession of law but they are humans too not only that they get paid whether they give correct or incorrect advice....i too would be very happy if you wanted to sue every lil old lady as long as you use my services - cha-ching!

We have become a bunch of whiney "it has to be someone elses fault) that is is pathetic!...so the legitimate cases get inundated with this fluff! The sooner we start holding individuals responsible for wasting the courts time the better for the justice system ... plus this is a HOBBY and correct me if i am wrong - but by now dont we / should we not all know that these things we "play" with are not toys? ...this is a hobby! ... if enthusiast of this great hobby have to start bracing for frivolous ("my lawyer told me to") lawsuits there is no telling what the future holds ...increased prices? ... ridiculous disclaimers? ...where would it stop? ... excellent sites like this and contributors may be on the list. stop it people! - please just stop it!! ...stop trying to supplement incomes on the backs of honest hard working people!

...sorry guys - just could not hold back anymore ....hope i am not violating any posting rules here.

ciao

..now let us get back to some heli stuff

I agree. If you've been in the game for as long as you say, you should have known better. Man up, admit you made a mistake, and stop trying to blame it on someone else when it's clearly your fault.

jeez, i read this thread a couple days ago and just laughed..... and now ill comment, to the OP, maybe you should sue your parents, "why? you might ask?" well, for mixing their dna in such a hapless and lackluster manner, as to create such mentally deficient offspring. ;-)

now, more seriously, YOU KNEW the TX was damaged. YOU screwed up. 'Nuff Said.

A case of too much money and not enough brains as it was said. just because you recieved an offer doesn 't mean you werent the idiot in this situation. You screwed up and used the legal system to make a profit off of it, as well as make yourself feel less stupid. plus i have a hard time believeing you were offered $5k You know what, it's people like you that are degrading this country. I hope you manage to start your car while its in reverse and run off a cliff, I bet if you survived youd blame the car manufacturer. And youd probably win.

Just because you got an offer doesn't make you right. In fact we all should write Art-tech to let them know they were not at fault and we would be glad to write a statement saying so.

Yep what Evan says. To add : I wonder if he also curses in front of his children. The saying goes that it is better to be thought of as a fool than to open you mouth and remove all suspicions. I think that when he looks at the WARNING statement in the manual or on the web site I think the lawyers will hit on that. A settlement offer that fast. I don't think so.

You realize you're bragging that you won money for stupidity and the fact that EVERY OTHER CUSTOMER now has to PAY MORE for the product because of you. If I could find out which club you fly with I'd post this entire thread for all of them. You're the reason we pay more for the products we buy.

How can you be proud of this? I hate to say it but... stop breeding now, we have more than enough stupidity in the world.

You're right dude. I mean just the other day I was having trouble getting my plane to fire up. I kicked up to half throttle and wouldn't you know the thing started just fine. What pisses me off is that it lurched forward and took my nutts clean off. ***? After I stopped the bleeding I took off and noticed that my controls were funny.....so I brought it in real low over the pitts to get a better look. Well wouldn't you know it I lost control and ran that ******* into the side of my new car. I mean Jesus Christ, what does a guy have to do to get one of these things to fly correctly? So who should I call I want my free money too. Who's with me?
