It is absolutely legal; IF and ONLY IF, you have a radio amateur's license.

I'm not exactly sure how to explain. You must demonstrate that you have a thorough knowledge of electronics (with respect to transmission and reception), and in my day you had to know Morris Code to send and receive at least 5 words per minute. You must pass a test. These days, no code is required for a Technicians license.

The license allows you to transmit and receive on particular frequencies, for communications, and in this case radio control. It allows you to build and operate your own equipment. In the early days, radio amateuring was used as a tool to advance the state of the art, with so many people doing, and sharing, their experiments.

These days its fairly easy to get your ham radio license. There is no need to learn morris code in order to operate your transmitter on 50mhz. There is a test that will need to be taken. Depending on your location, there is a high probability that there is a club in your area that administers the test. You can get study materials from Radioshack as well as the ARRL (amateur radio relay league, which does the same thing as the AMA, just for ham radio instead of radio control).

I'm on 50mhz, channel 02. I never have to wait to fly unless there are too many birds in the air already.

Good Luck.
