If the seller shipped an airplane with a tank full of fuel, not only was that illegal (unless he paid hazmat fees) but also destructive to the airplane. I'm guessing you didn't know about the broken needle valve either before paying? I would definitely be talking to this guy about a return or partial refund unless you got it dirt cheap and he disclosed that the plane was fuel soaked beforehand.
