The employer can only withhold what you tell them to. If they are holding any more or less than that they're doing something illegal. In the situation that you described about them holding back pay "so the employee was taken care of" had very little to do with helping the employee, and would probably be more like they are "holding" that back to help the employee and in the meantime the company collected interest that they drew from the little account they set up to hold that money in. That's probably closer to the truth. It's amazing to me the scams that huge corporations like that think up to make an extra buck or two.
