6102 problem

Recently I purchased a new JR 6102 radio from my LHS. A few weeks ago I had it out with my son. The 6102 was the master and my son was on the buddy box. I pushed the button and he had no control over the airplane. I let go and pushed again and it worked, I wrote it off to not pushing down hard enough possibly. Then my son got in trouble with a dive. I let go of the button and it did not pop up. Frantically I kept pressing until it finally popped back up and I had control of the airplane but it was a close call and had my heart pumping.
What do you think the problem is?
