I negotiated a deal with a guy for a plane. I asked what the shipping was to my zip code, he told me had shipped another one for $10.00. I made him an offer for $85.00 for the plane and $10.00 for shipping a total of $95.00. This price was confirmed over the telephone on my e-mail which I still have on my computer on through the marketplace forum. I mailed him a Money Order for the amount agreed upon. He has cashed it and sent the plane. Now he e-mails me and claims I owe him more money because the shipping I had sent him wasn't enough. It's only $7.65, but the deal wasn't for actual shipping. I made an offer and he accepted. He tells me that he couldn't have know how much it was going to cost to ship to me even though I had given him my zip. I replied that when I sell something and the buyer wants to know th actual shipping I go down to UPS and get an actual cost and then e-mail the buyer back. He say if I won't pay the extra shipping to refuse the delivery and he will refund my amount minus $17.65 fo shipping it to me in the first place. That's not going to happen because $10.00 of that is my original shipping payment. So what do I do? I'm not legally obligated for the extra shipping we reached an agreement of $95.00 with no agreement of actual shipping cost, he is just trying to push the cost off on me.[:@]

I have had this happen to me where I asked for actual shipping and the buyer sent me $10 dollars to cover it. In most cases, I refund the difference. If that was your agreement, then you owe him the extra actual shipping. If he asked for $10 to cover shipping and if less, you would not get a refund, then you owe him nothing.
Can you say which is it?

Sounds like the seller did his best to estimate the shipping based on a previous sell. Remember the seller is probably not a shipping expert. The plane could have come up as oversize. He wouldn't have known the cost until he actually shipped.
You'll have to decide if the total deal, including the extra charge, is a good deal on the model. You certainly have the advantage in this deal. If the roles were reversed, how would you react. If getting the model $7.65 cheaper gives you a warm fuzzy, go for it. I suspect that if the seller had initially quoted $17.65 for shipping, you'd have made the deal anyway.

Will, Not really. With extra shipping charge makes cost $6.00 less than retail. I guess what urks me the most is the fact that we reached an agreement and he is breeching it.

If that was the agreement that he accepted as well, then he is changing the contract. Ask him why? If he figured that he would make a little extra then he is a little shady and negative karma for the two of you is in the future.

Geistware,
That was not the agreement. $10.00 to cover shipping period.
