I ordered a few indoor planes and some depron. The day after I placed my order sent the shop me an email. They said that they had to cut the depron so that they could pack it in a box for safe shipping and that they would wait to send me the package before I confermed that the cutting part was ok.
a few minutes later they emailed me again and said that the package was sent. The problem for me is that I read those email a few hours later, it was already too late to cancel my order. They basicaly just cut the depron and shipped it without knowing that I was ok with it.
And since I need the depron without any cut to build my airplane I emailed them that I`m not responsible to pay for the shipment back to them. Who do you think is responsible for this?

Hi,

Not knowing anything about consumer laws in Norway and being hopeless at trivia. I would suggest that you:

1. Contact your equilivant of the "Dept of Fair Trading".

2. Contact your equilivant of a "Chamber Magistrate".

I assume, (with all the usual disclaimers) that as the supplier hasn't provided you with what you ordered or authorised that it is their problem but it still leaves you without your depron.

I would contact the company again.....tell them again about the 2 e-mails.....and that you didn't have time to respond before they shipped your order.....that the order in this condition is not what you ordered and will not accept it....don't be afraid to ask to speak to a supervisor if you aren't getting satisfaction...as a matter of fact keep asking for a supervisor's supervisor until you get the problem resolved

I don't believe that they cut the pieces for "safe shipping", I think they cut the pieces for "cheap shipping". They probably screwed up when they quoted your order, and didn't realize that they would have to pay for an oversize package.

The original email said that they would not cut the material without your authorization. You didn't give them authorization, so you should not be held liable. They were probably just taking a chance that you were OK with it and wanted to fill your order as soon as they could.

Regardless, they did not provide you with what you paid for, and you should not be responsible for the return shipping. The material is scrap at this point anyway. I would try to speak to somebody in charge.

I agree. It is definitely NOT your fault. Call them immediately and tell them you cannot use and do not want the depron cut. If they don't fix the problem for you, tell them you will refuse shipment and file a dispute with your credit card company/bank for the charges. If they try to screw you, post the company name & info here so we'll know not to deal with them as well!

I tend to think it's your own fault. But I'm ASSuming a few things.

Here is what I do BEFORE ordering an oversized item from someone new:
CALL THEM .... ON THE TELEPHONE

Talk to them and tell them EXACTLY what you want. Tell them you CANNOT accept delivery of the product if they cut it down or resize it in any fashion.

Be prepared to pay for the shipping.

I do think they rushed your order out the door without consulting you on the size and shipping issues.

But I also think you had the initial burden of making sure they would actually ship the item you ordered without cutting it apart. Thats your own fault.

The fact that they did cut the product without asking you first is pretty stupid on their part.

I'd personally call it a wash at this point and follow w8ye's advice. Don't order from them again.

Actually, since they knew enough to ask first, and then decided to cut it and ship it anyway, they can't claim ignorance. They knew he might not want it cut down, and decided not to wait for his response. They took a chance and they lost.

The actions of this retailer is simply stupid to an extreme and any suggestion that this customer is somehow cupable by omision of every possible senario is absurd.

Murdoc I have no idea if you will ever get squared away with this outfit and I have my doubts but its time to let your fingers do the walking.

I called them but they did not answer my calls. I`m pretty busy at work these days so I cant stay on the phone all day long.
So I had to email them again and they said I was resposible for this. I`m not giving up yet, they sendt me something I did not order.
I`m very curious to see how this turns out, but to be honest I think they are "trying" me to see if they can squeze some money out of me.
99% of all web orders are usually delivered without any problems, so I guess I got cought in a crack here.

Murdoc: the balsa I already sold to you has been cut in small tiny nice pieces so you will have a tiny and nice package, the proces of cutting has a cost I hope it does not bother to you now you own 15 bucks more.

How did you pay? Paypal or credit card? I'd file a complaint with whoever you pad with. Paypal has been really great at taking care of issues like this for me. Definitely not your fault, and just plane stupid on their part [&:]

Seems like I`m in some trouble here I used paypal, will contact them and see what they can do about it.
I dont want to make a big fuss about some shipment expenses, but I just think that this was not my fault. I`m not a rich guy but I allways pay my bills. unpayed bills gives me the worst feeling ever.
