Capice? What are you Tony freakin Soprano now??
So your saying that my trimschemes/planes are in fact illegal to make and distribute, dispite the fact that I will not make a single dime?
Are you the same [link=http://72.14.203.104/search?q=cache:LQZtNeyoKD4J:the.honoluluadvertiser .com/article/2002/Mar/12/tc/tc03a.html+dion+cini&hl=en&gl=us&ct=clnk&cd=5]Dion Cini[/link] that stated publically...
But officials at one site, St. Louis-based CopyMyDVD.com, said they are doing nothing wrong. Consumers have the right to copy their DVDs for personal use under the 1992 Home Audio Recording Act, CopyMyDVD spokesman Dion Cini said.
Cini also said duplicated DVDs are inferior to the original copies in terms of image and sound quality, so they should be exempt from laws protecting DVDs.
"We are not making an exact replica of a DVD," he said. "It's not a complete and legitimate product."
I think you are, and if I am right wouldn't that make you the worlds largest hypocrite?

Rick you think I'm trying to start trouble and I'm not. You seem to be going from one extreme to the other extreme and we can't meet in the middle. As much as you like and enjoy reproducing other manufacturers models and schemes you still have to respect their concerns as well. You don't have to quit modeling just over a simple request like asking for a plug for use of shape.
The reason that I asked you to put the FlyingThingZ URL on your mower was only because if someone else saw it and didn't know that FlyingThingZ existed ... they may like it and copy it or do something else with it. With the URL on there the chances are very unlikely. Nobody is trying to make trouble for you, only you. The digital world is changing the way things get copied, it's making it very easy to replicate and take what does not belong to you. If you modeled your mower from the AFPD mower ... then guess what ... it's modeled from the exact CADS. Capice?
If you don't like the fact that manufacturers are coming down on you for replicating their models or schemes without a simple courtesy phone call or permission it's not that you are doing something wrong, not us. We want you to use our models. Heck only 48 hours I gave Jim Bourke permission to use and OMP or FlyingThingZ plane for G3 and he was very happy about that. I only asked that he clearly plugged FTZ or OMP for the use there of.
And this crap about Fokkers, Edges, Extras and other planes I could care less Prop Nut. Those are not my models, your just being a wise guy.
But you guys might be really surprised to know that there are court battles going on from companies like Republic, American and Northrup suing diecast companies and other companies for use of the warbirds. It's getting ugly since the taxpayers were the ones that funded the planes in the first plance. But it just goes to show you that it's not always take take take. And your analogies like use of the NYC skyline is much different.

I was just reading through the provisions of the "fair use" law you cited earlier.
How can I tell if my copying is allowed by fair use provisions of the Law?
There are no explicit, predefined, legal specifications of how much and when one can copy, but there are guidelines for fair use. Each case of copying must be evaluated according to the following rules
"If the copy is distributed without charge"
Anyone want to comment?
This affects all sim users BTW
Nemo and Jaffit please break your silence and chime in on this?

I am curious did the users who created the "1000's of downloadable models for AFPD" obtain the proper "permissions" from the respective copyright holders?
I saw someone just made the KingCat available for AFPD -did you obtain permission from Bob Violet models??
nemo uk, Lego and Rodeo did you obtain express permission for ALL of the aircraft you have copied???
cwehner of W3 group, have you been obtaining express permission for all of your work done for Reflex XTR????
C'mon guys dont be shy lets talk about this!

You know what Rick I don't care who asked who what to copy whatver plane they copied. This is exactly why I requested why you put the URL on the mower if you are going to distribute it, seeing you don't know the difference between taking and asking.
Do me a favor, do NOT copy any OMP or FlyingThingZ models EVER.
You think I'm being this jerk when all I'm doing is trying to protect other people's hard work which you obviously have no respect for. If you want to find out what happens when you take someone else's hard work then distribute it without permission, give it a try and watch what happens. There is no need to discuss it.
You can do whatever you want Rick, you can copy anything in the world you want for you own use. But once you start distributing other peoples property for free or not for free, you should do what they ask. My suggestion is to take the FTZ mower and change it to whatever shape you want instead of an exact copy of something we paid for to be designed and modeled for AFPD.
Did you not see the BD-5 thread for AFPD. When Lego saw that Pat borrowed his sound file? He about had a fit ... that's because Pat took without asking, accidentily of course. But still goes to show you that I'm not the only one that feels this way.

Oh and by the way Dion duplicated Planes and Trimschemes are inferior to the original copies in terms of image and sound quality so they should be exempt from laws protecting Copyrights.
I am not making an exact replica of a Plane or Trimscheme, so It's not a complete and legitimate product.

Hmmm, have any of you watched the demos of OMP planes in action? Some of the ones that I watched had music attached to heighten the drama.........I wonder if OMP has obtained a copyright liecence from the record companies to use thier music to sell planes.........that would constitute making a profit using someone elses ideas, creative geneous etc..................Hmmm. I just checked.....they are using some bluegrass song to show thier flying lawnmower, I wonder if that is STL singing on there? I know that AeroSmith is the group singing thier song "Pink" on the flying doghouse video.........did Steven Tyler get his name on the kit? On the Video? On the website someplace? Did his record label get paid a fee for your using his music to sell your product? Hmm..................?

Like I said Rick, distribute it to find out what happens. Your model is based on the AFPD model that we had created. You did not get permission to copy the model and it looks like you want to battle me over it. If you think it's inferior, we'll just let others make that decision. Like I said, change the shape and you can do whatever you want with it. Since you don't have the comprehention to respect our wishes, nor do you understand intellectual property rights, I do not want you distributing the models. How can we trust you with this.
The reason why you don't see this happen elsewhere is that anyone else would be more then happy to agree to the wishes of the designers. You want to start an uprising against me with your little trolls. I'm sure Patrick Libby would be more then happy and appreciative to BVM models seeing he let him use his 3 views for the models if Bob asked.
I didn't create the BD-5J.
Your not the first person to bring this to my attention and I will tell you what I told them, tell the record companies, let them know!

Who's drawings did you replicate to create the BD5? Are you really that big of a hypocrite?

I am going to lock this thread until I have time to clean it back to its original purpose, which is not to discuss intellectual property rights. If someone wants to start a new discussion in this forum on IPR as it relates to R/C simulators and its software components, you are welcome to do that. It is considered poor etiquette to hijack a thread.

Anyone else having problems on the RCMAC field??? I get booted for no reason at all after about 3 min. It says something about failing to load 1 player.

Hey I made a "flying lawnmower" and G3 is now selling a "flying lawnmower". I have no idea what G3's mower looks like, everyone knows how mine looks. Does anyone think that the G3 mower is going to be different than mine?

Alot of people get randomly dropped from multiplay. Alot of times they wrongfully accuse the host of booting them and it gets ugly sometimes. Since you can re-join a session even if you get booted most hosts dont bother booting other players anyway. Somedays I cant join a session at all, hopefully KE guys are looking into this.

Dropped because of "Connection to one player" happens to me alot also. Personally I blame the fact that Saturn is in the house of Mercury, and he didnt lock the back door.
