Before I got into turbines I flew a DF Byron F-16 there. One of the first things I was told when I arrived at the field was that if my plane ended up in the corn field I would just have to write it off.

i have flown there before. it is a nice field. the farmer grows corn off the end of their runway. however, he is a descent distance from the runway. when i flew there i just took my reaction so i could stay away. he is always lurking nearby. the club has been there i think 20 or more years. just a sad angry man, barry

Here is what a member of the club where it happened had to say on another site:
"This farmers house is about 1/2 mile from the RC Club flying field and we have been having trouble with this guy for many, many years. It isn't his first run in with the law. The RC field is Fort Bend County owned and partially maintained and is to be used by County residents. The farmers field in reference is a maze crop. He lives so far away, noise isn't the issue, his argument was that downed planes would damage his crop when pilots would retrieve. Doesn't hold much water now, since he has cut a path through his own field all the way to his house so he can drive down to our end, set up camp and shoot at our planes all day. He has been sitting in a lawn chair in the back of his pickup shooting at plane after plane for years. He has hit more than one, usually during final approach when they are the most vulnerable. Since he parks so close to the property line, he doesn't always wait for them to cross onto his property before he lets loose. What's worse, even though he built a path through his field to get home, he sometimes uses our (county owned) drive way to reach his hunting grounds, and there is nothing we could do about it since he lives in the county. The county and the club are currently in the process of moving the flying field several miles away from this site. Unfortunately for the pilot and the farmer, both lose in this deal." |

gerry, shooting thieves in any body part in texas is legal. i suppose if the home that was broke into had a sick child stay home that day when the thieves broke in would have changed things. it is what it is, texans are sick of and dont put up with it. as for the farmer, he has been a bitter man for many many years. i generally steered clear of this field because of this guy. every time i flew there i would see him. he would just sit in that truck. i guess he didnt have a life. barry

In our area we are worried about neighbors complaining about noise. People do not shoot at us, but if they complain about noise, we are doomed. The problem is that we normally rent part of a farm, and at that time is always alone, surrounded by fields, no neighbors. Then, they develop one of the fields, and houses start to pop up. You can inagine the rest of the story... In our current field we have houses kind of near, but no complaints so far. All it takes is a crazied complaining neighbor to shut us down. I am sure this crazied farmer will pay for what he has done... He just was unlucky enough to hit a very expensive piece of hardware (well, "not hard enough ware" Gerry I'm sorry but if you burglarize a house you risk getting yourself killed. I don't feel sorry for those criminals ONE BIT. They deserve what they got. One thing I do know, criminals will think twice before breaking in people's houses. In Louisiana citizens actually have the right to shoot to kill if you try to carjack them. Another good law. If someone broke into my house and I'm home, they will be met with a 12ga shotgun blast in the face. Andy |

Well just like the bumper stickers say " Don't Mess With Texas".... Well im glad the farmer got 6 months in jail. He should have got more time then that considering this wasn't his first time in jail... Im going to talk to my brother who is a cop out in that area to see if he can give me anymore info what is going on. And for the 2 ciminals the got shot in the back for breakin in to the mans neighbors house, well they got what they deserve. This is Texas and Don't Mess with Texans !!!!!!!!! And like others say in article he doesnt own the airspace, nobody does.. Well maybe the goverment and God..... BUt still he had no right to shoot the plane down with buck shots pellets and fods out the turbine. oh well vent more later.

I do think this guy was an ***** for doing what he did especially without trying a more peaceful approach. BUT, From ground level to 500ft AGL in class G airspace is a non flight area. If the court rules this to be a UAV aircraft because of the size,weight and powerplant and the farmer has previously filed a noise complaint and nothing was done about it. They may just let him off. Basically its the same as the neighbor tree law-(Georgia) If a tree growing in your neighbors yard hangs 3/4 over your property line you have the right to have the tree removed. So its like you do own the airspace above up to 500ft.

Just because manned aircraft are not supposed to fly below 500' does *not* mean that the land owner owns that airspace and can do anything they want with it. As far as the UAV thing is concerned, a Kingcat configured in normal RC mode and being operated for recreation is *not* a UAV according to the FAA and I'd have a really hard time seeing a court disagree with that catagorization - and its immaterial to the issue anyway... truly a bizarre story, I would of done something like go over to the fence line and then pelt him with a bb gun or a paintball gun from behind the crops while he tried to shoot at the planes. Total loser and a burden on society. Guys like him are better off not alive...angry? yes I am...

Many years back, the FW Thunderbirds caught two guys that had rigged up a TX that would transmit on all of the (old style) 72 frequencies. They also had a couple of Txs on 53mHz.
The sad thing was that they were r/c flyers that flew at the field.... They were hiding behind a low hill behind the flying field and shooting down planes...electronically. They were the cause of 50-75 crashes over a several month period. They would look to see who was flying with binoculars and pick their victims...people that they did like. They did this during events that closed the field, mostly. They had issues with the field being closed for events, among many other issues. They were the two most incredibly annoying people that flew at the flying field back them. We caught them in the act and detained them for the sheriff. They were arrested and spent the evening in jail. The case went to criminal court, with the charges being destruction of private property in excess of $500. The trial ended with a hung jury. The word was that a couple of ladies on the jury could not see sending those guys to jail from crashing toy airplanes.....sigh. The ringleader of the pair did loose his job at a local aerospace firm, due to the criminal charges and publicity around them....so he did pay a price. I hope this farmer that caused the Kingcat to crash goes to jail for his offense. |

i was there right as the cops pulled away. i would name the pilot, but i would rather keep his identity private. lets just say that if you know the h-town jet crew, you know this guy.

No matter what kind of airspace he has over his head...unless he is also the local FAA goon...he can not use force of any kind to correct an issue. Heck...even the FAA can't "shoot down" an airplane...it goes higher than that.
